Terms and Conditions

Welcome to our website. These terms and conditions (“Agreement”) set forth the general terms and conditions of your use of the alphaanimalphysio.com (“website” or “service”) and any related products and services (collectively “services”) provided by Alpha Animal Physiotherapy Ltd. This Agreement is a legally binding contract between you, the customer (“client”, “user”, “you” or “your”) and Alpha Animal Physiotherapy Ltd. (“us”, “we” or “our”), even though it is electronic and not physically signed by you. By accessing and using this website and our services, you acknowledge you have read, understood and agree to these terms and conditions in full. 

Veterinary Referrals and Owner Consent

Prior to a visit from us, you must identify whether your animal is receiving physiotherapy for maintenance purposes (i.e. is healthy to your knowledge, with no ongoing or underlying health conditions, and your animal has been seen by their registered veterinary practice within the last 12 months). If this is the case an “Owner Consent Form” must be completed in full prior to any visit taking place.

If your animal does have a health condition, a recent injury or is not otherwise fit and healthy, a referral from your registered veterinary practice will be required prior to any visit taking place. This ensures that your Veterinary Surgeon has seen this animal and knows its current health status. The “Veterinary Referral Form” must be completed in full by your registered veterinary practice prior to any visit taking place. This is a requirement under The Veterinary Surgeons (Exemptions) Order 2015, should this not be completed and returned prior to an appointment, the appointment will be cancelled, and you will need to reschedule.

Appointment Preparation

Clients must ensure that their horse's or dogs are suitably clean prior to any veterinary physiotherapy appointments and for Hoof Boot Fitting appointments, horses feet must also be suitably clean to ensure an effective and accurate fitting process. Failure to meet this requirement may result in the appointment being rescheduled or additional charges being incurred for cleaning services.

For Hoof Boot Fitting, horses should have had their feet trimmed within 2 weeks of the appointment date.

​Hoof Boot Fitting

 

​The fitting service is provided based on professional expertise and advice given during the appointment. Recommendations made during the fitting are tailored to the specific needs of the horse and are intended to optimize comfort and performance.

Hoof Boot returns are accepted solely at the discretion of the Director. The return process is contingent on compliance with the advice provided during the appointment. Products must be in their original condition and packaging. The Director reserves the right to deny returns that do not adhere to these conditions.​

Payment and Travel Expenses

All fees for services provided by us are payable upon the day of treatment unless otherwise approved by Rhiannon Kelsall (“Director”). Fees will be shown on a detailed invoice provided after a treatment session or following a Hoof Boot Fitting appointment.

 

Milage is charged after 10 miles at 45 pence per mile calculated from the business address to the clients address and back again. If more than one animal is being seen at the same address on the same day, this milage charge can be split between the animals' owners. If multiple appointments at different destinations are being made during the day, the cheaper option for travel costs will be applied. This will be calculated based on the distance to the next appointment or back to the business address, whichever is less expensive.

Payment can be made via cash (with a receipt provided for your records) or BACS (see invoice for details). Any queries regarding your account should be raised within 14 days of the date of invoicing. We reserve the right to charge 2% interest per month on any account not paid within 14 days of the date the invoice was created. Any unpaid accounts may be pursued in any manner we deem appropriate; any cost incurred by us in recovering unpaid accounts will be passed to the respective client.

If you wish to pay for services in instalments, this can be arranged upon approval of the Director. There will be no interest payable for installment payments unless payments are missed, in which case, 2% interest will be applied for each day this goes unpaid. Cancellation Policy

Whilst it is understandable that on occasions extenuating circumstances may arise forcing you to cancel your appointment, in other occasions a minimum of 24 hours’ notice is required for any cancellations, if this is not met, we reserve the right to charge 50% of the appointment cost. 

Complaints

We aim to deliver our customers a 5-star service in all areas of our business. However, if you feel you are not happy with any part of the service you have been provided with, we ask that you first discuss these issues with the Director of Alpha Animal Physiotherapy Ltd.

Indemnification and Liability

You agree to indemnify and hold Alpha Animal Physiotherapy Ltd., all affiliates, the director or consultants harmless from and against any liabilities, losses, damages or costs (including attorneys’ fees), incurred in connection with or arising from any third-party allegations, claims, actions, disputes, or demands asserted against any of them as a result of use of our website or services. All relevant parties of Alpha Animal Physiotherapy Ltd. hold professional liability insurance, therefore limitations and exclusions of liability shall not apply to any liability for death or personal injury caused due to our negligence or any other liabilities that cannot be lawfully excluded.

Alpha Animal Physiotherapy Ltd. and associated persons cannot be held responsible for: a. The incorrect use of hoof boots by the owner. b. Any damages to the hoof boots once they are in the possession of the client. c. Injuries to the horse arising from the misuse or incorrect application of the hoof boots.

Clients are advised to follow the fitting and usage instructions provided during the appointment to ensure the well-being of their horse and the integrity of the product. We will not be liable in respect of any defect in the products arising from fair wear and tear, wilful damage, accident, negligence by you or a third party, use otherwise than in accordance with the manufacturer’s instructions or recommendations, or any alteration carried out by you or any third party.

Always inspect equipment for signs of wear, damage, or tear before each use. Discontinue use immediately if damage is detected and, if within the warranty period, return the product to The Hoof Boot Shop for repair or replacement. Hoof Boots are used at the owner's risk. Alpha Animal Physiotherapy Ltd is not liable for injuries, damages, or malfunctions arising from their use. 

 

Hoof Boots are advised for general horse riding activities. Use in fast or extreme equestrian sports (e.g., Polo, Racing, Hunting) is not recommended. Alpha Animal Physiotherapy Ltd does not accept liability for injuries or issues arising from such use.

Owners are responsible for ensuring equipment is suitable for their horse and specific activities. Always consult expert advice if unsure and read the User Manual thoroughly.

The content included should not be relied upon for making any veterinary or legal decisions. Whilst we make every attempt to ensure the information is correct and up to date, we make no guarantees or warranties, express or implied, about the accuracy, suitability and reliability of the information or services provided. Reliance upon the material provided is at the users own risk. 

Intellectual Property Rights 

This agreement does not transfer to you any intellectual property owned by Alpha Animal Physiotherapy Ltd. or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with us. All trademarks, service marks, graphics and logos used in connection with the website, services or social media associated with us, are trademarks or registered trademarks of Alpha Animal Physiotherapy Ltd., its licensors or other affiliates. Other trademarks, service marks, graphics or logos used in connection with the website, services or social media associated with us may be the trademarks of other third parties. Your use of our website, services or social media grants you no right or license to reproduce or otherwise use any of our or third-party trademarks. Unauthorised use of the website may give rise to claim for damages and/or be a criminal offence.

Across our website, social media pages and other platforms linked to this business, we may on occasion share or post links to external resources. We are not directly or indirectly, affiliated with, implying approval, sponsorship or endorsement of any linked resource unless specifically stated herein. We do not assume any responsibility for or liability for the actions, products, services and content of any third parties. Your linking to any off-site resources is done so at your own risk. 

Dispute Resolution

The formation, interpretation and performance of this Agreement and any disputes that may arise out of this Agreement shall be governed by the substantive and procedural laws of the United Kingdom. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in the United Kingdom and you therefore submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or in relation to this Agreement.

Changes and Amendments

We reserve the right to edit this Agreement or the terms related to the Website and Service provided by Alpha Animal Physiotherapy Ltd. at our discretion. When we do so we will update the date at the bottom of this page. Any updated version will be effective immediately unless otherwise specified. Your continued use of the website services after the effective date of the revised Agreement will constitute your consent to those changes.

Acceptance of Terms and Conditions

You acknowledge you have read this Agreement and accept all of the outlined Terms and Conditions alongside the 'Data Use and Privacy Policy'. By accessing this website and using the services, you agree to be bound by this Agreement and fully understand how we use and process your data.
